AB 2499 Victim Leave Notice Has Been Released

AB 2499, signed into law in 2024, expands protections for employees who are victims of violence – as well as protection for employees when family members are victims of violence. Specific prohibitions exist for those California employers with 25 or more employees. Among its provisions, the law prohibits employers from denying an employee time off to serve as a witness in court, seek a relief related to being a victim of violence, or engage in other victim-related legal or recovery activities, among other provisions. These protections aim to ensure that impacted employees can take necessary leave without fear of retaliation or job loss.

The Civil Rights Department (CRD) has published a model notice titled, "Survivors of Violence and Family Members of Victims Right to Leave and Accommodations." Employers are required to inform each employee of their rights in writing:

  • Upon hire;
  • Annually;
  • At any time upon request; or
  • At any time an employee informs an employer that the employee or employee’s family member is a victim.

Employers have the option of using the CRD notice or could choose to create their own notice, so long as it meets the notice requirements.
