Watch: Equal Access To Extracurricular Athletics

Since 2004, IEP teams have been responsible for considering what accommodations a student with a disability may require in order to access extracurricular activities. With this new responsibility came new questions–and much litigation–regarding a district’s obligations to provide such access. In January 2013, another layer of complexity was added by a Dear Colleague letter issued by OCR, which potentially expands the obligations of districts to provide equal opportunities for participation in after-school sports.

On January 25, 2013, the Department of Education’s Office for Civil Rights (“OCR”) issued guidance that clarifies a school district’s existing legal obligations to provide students with disabilities an equal opportunity to participate alongside their nondisabled peers in after-school athletics. This webinar reviewed these requirements and the impact on school districts.
