Important Webinar on New Workers’ Comp Law

Please join Keenan Thursday, February 21st at 10:00 a.m. for a very timely webinar on the new Workers’ Compensation law, SB 863. This is the most sweeping change to workers’ compensation in the last decade, incorporating many new obligations for employers.

The state has approved several emergency regulations that went into effect back on January 1, 2013, and Governor Jerry Brown’s budget proposal has items directly related to implementing this new law. Ultimately these new items will be funded by user assessments and include the following:

  • Increased Staffing for Department of Industrial Relations (DIR) – DIR will gain 82 new staff positions with the majority going to the Department of Workers’ Compensation. Additional positions will support improving Medical Provider Networks, developing new lien processing, implementing new fee schedules, and creating an independent review process for treatment and billing disputes.
  • Increased Staffing for Office of Self-Insurance Plans (OSIP) – OSIP will see three new positions to begin auditing public self-insured employers in 2013. See our January 2013 Briefing regarding OSIP changes for public self-insured employers for further details.
  • Return-to-Work Fund – SB 863 authorizes creation of a $120-million return-to-work fund that will be known as the Special Earnings Loss Supplement program.
