A New Department Of Labor FAQ

The Labor (DOL), Health and Human Services (HHS), and the Treasury Departments have published a new batch of Frequently Asked Questions (FAQ) about the Affordable Care Act (ACA). These questions come from ACA stakeholders and the DOL publishes them to facilitate compliance with certain ACA mandates. Among the issues highlighted in the FAQ are:

  • An employer who offers their employees cash reimbursement for the purchase of an individual market policy is in violation of the ACA’s market reform provisions
  • An employer who offers an employee with high claims risk a choice between its standard group health plan or a cash payout is in violation of the ACA’s market reform provisions
  • An employer who cancels their group policies and sets up a Code Section 105 reimbursement plan in order to allow eligible employees to access premium tax credits on their state Marketplace is in violation of the ACA’s market reform provisions
