Possible Changes to MHPAEA Compliance

SB 22 is currently working its way through the California Senate. This bill would require health care service plans and health insurers to submit an annual report certifying compliance with the MHPAEA to the Department of Managed Health Care (DMHC) or the Department of Insurance (DOI). This report must also contain a survey of enrollee and provider responses about their experiences with mental health and substance use care.

The DHMC and DOI will use the submissions to create a unified report for the legislature along with explanations of any regulatory actions taken as a result of information provided by the reports. All reports would be published on the DHMC or DOI website. These documents would be public records and be made available upon request.
